Terms and Conditions of Service

The parties to this contract and agreement are:The client as detailed in the in Client Information overleaf, (Hereinafter referred to as “the Owner”) AND The Dog Walker as detailed in the Consent Form overleaf, (Hereinafter referred to as “the Walker”)

 

The parties above stated addresses MUST be their physical address at which legal proceedings may be instituted.Whereas the Owner wishes to engage the Walker and the Walker agrees to undertake the services under the terms and provisions defined in this Dog Walking Contract as well as the Pet and Owner’s information(s) and the Veterinary Release Form which shall all become part of this Contract. Any reference to dogs in this contract shall refer to those specified on the Pet Information sheet(s).

 

Rate

Pick up the Paws will be paid as per the rate detailed overleaf.Payment Policy: There will be a £15.00 fee charged for any returned cheques.

 

Duration

This Dog Walking Contract shall come into effect on the date agreed overleaf and shall:A. Terminate on the date specified overleaf ORB. Terminate when either party gives 7 (seven) days writtennotice of termination.

 

Cancellation or Early Termination

• Either party may terminate this Dog Walking Contract a minimumof 24 (twenty-four) hours prior to the first scheduled visit withoutincurring penalties or damages.

• Dangerous weather such as major storms / severe rain includingsub-zero temperature my result in cancellation and negates the24hr cancellation period, this is entirely down to the discretion ofPick Up The Paws to whether it is safe to partake in a walk duringthose conditions for the health and safety or both parties involved.

• Cancellation by the Owner of scheduled walks with less than 24 hrsnotice may be charged at the full rate or rescheduled at the discretionof the Walker.

• Cancellation due to unforeseen circumstances by Pick Up The Paws willresult in an immediate refund.

 

Responsibilities

It is Pick Up The Paws responsibility to make sure the ‘dog walking agreement’ is complete and all required information is taken. An initial meet and greet should be undertaken to the satisfaction of Pick Up The Paws before any dog walking can commence. This is to ensure the safety of both your dog and the walker.

 

Client:

Shall retain as an independent contractor.No employer/employee relationship is implied or established with contract. Pick Up The Paws is solely responsible for procuring the necessary insurance and complying with any applicable regulations.Pick Up The Paws agrees to carry out a dog walking service in a professional, reliable manner, taking care to always treat my dog with respect and care.

 

Client:

Agrees to provide any information necessary for the proper care of the dog listed.Pick up the paws shall ensure that any faeces are picked up and properly disposed of while carrying out dog walking duties.All Pick Up The Paws employees are to have undergone Canine first aid training and MUST carry a relevant first aid kit.All Pick Up The Paws employees MUST undertake and posses a valid DBS check.

 

Client:

Recognises that Pick Up The Paws right to walk dogs for other clients in addition to their dog unless specified by a one-to-one booking. Pick Up The Paws agrees to limit the number of dogs being walked on any one occasion to 4 (FOUR) dogs per individual.

 

Client:

Shall be responsible for providing collars, leads, and muzzles for the pets listed as needed. If on inspection any defects are noticed, it is at the discretion of Pick Up The Paws to whether the walk can commence. If for safety concerns, it is deemed that the walk cannot proceed you may still be charged.Pick Up The Paws shall not be liable for duties not explicitly listed in this contract.

 

Liability

• Should any dog become aggressive or dangerous, the Walker mayterminate this dog walking contract with immediate effect

.• Any wrongful or misleading information in the Pet and Owner’sinformation sheets may constitute a breach of terms of this DogWalking Contract and be grounds for instant termination thereof.

• If Pick Up The Paws is unable to access your dog due to problemswith doors or keys, you may be charged at the full rate or rescheduledat the discretion of the Walker. If the dog is not on the premises foragreed upon pick up time, you may be charged at the full rate orrescheduled at the discretion of the Walker.

• The Walker accepts no liability for any breach of security or loss ofor damage to the Owner’s property if any other person has accessto the property during the term of this agreement.

• The Walker shall not be liable for any mishap of whatsoever naturewhich may befall a dog or caused by a dog who hasunsupervised access to the outdoors.

• The Owner shall be liable for all medical expenses and damagesresulting from an injury to the Walker caused by the dog as well asdamage to the Owner’s property.

• The Walker is released from all liability related to transportingdog(s) to and from any veterinary clinic or kennel, the medicaltreatment of the dog(s) and the expense thereof.

 

Indemnification

The Owner will not blame and payback the Walker against all costs, expenses, losses, liabilities and claims arising from said dogs’ behaviour unless the dog walker is wilful or negligent.

 

EmergenciesIn the event of an emergency, Sarah Hough or the Relevant Pick Up The Paws dog walker shall contact the Owner at the numbers provided to confirm the Owner’s choice of action. If the Owner cannot be reached timeously,

the Walker is authorized to:

 

• Transport the dog(s) to the listed veterinarian.

• Request on-site treatment from a veterinarian.

• Transport the dog(s) to an emergency clinic if the previoustwo options are not feasible.

 

I authorize emergency medical care to be provided by the named veterinarian listed on my pet’s information sheet, or an appropriate alternate to be determined by Sarah Hough and Pick Up The Paws in the event that my regular veterinarian is not available or that closer care is required. I will reimburse Sarah Hough and Pick Up The Paws for any charges related to emergency care.

 

Security

The Walker warrants to keep safe and confidential all keys, remote control entry devices, access codes and personal information of the Owner and to return same to the Owner at the end of the contract period or immediately upon demand.

 

Whole Agreement

This Dog Walking Contract and Pet and Owner’s information sheet(s) and the Veterinary Release Form attached constitute the sole and entire agreement between the parties with regard to the subject matter hereof and the parties waive the right to rely on any alleged expressed or implied provision not contained therein. Any alteration to this agreement must be in writing and signed by both parties.

 

Assignment

No party may assign any of its rights or delegate or assign any of its obligations in terms of this Dog Walking Contract without the prior written consent of the other party, except where otherwise stated.

 

Social media

If authorisation has been given to post photos on social media:

 

Photographs taken will be used for business social media and will be taken during the walk and may include photos of your dog. No photographs will be taken at your home or disclose any information that could put you or your dog at risk.

 

Walking dogs off lead

If agreed to by the Owner, the Walker has permission to walk the dog(s) off lead. By doing so, the Walker agrees to only walk the dog(s) off lead at safe and appropriate times and places.Dogs are required to have good recall and an ID collar along with being microchipped.

 

Liability Waiver & Policies.

All Employees of Pick Up The Paws, will endeavour to offer only sound, safe, and responsible care for my dog(s). However, I recognise that Pick Up The Paws is not responsible for any unintentional errors, omissions, or incorrect assertions.

 

I understand that the recommendation of any other product or service is not a guarantee of my satisfaction with that product or service. Further, I am and will remain responsible for the actions of my dog at all times and I hereby agree to indemnify and hold harmless Sarah Hough and Pick Up The Paws of any and all claims of injury, expense, costs, or damages caused by the actions of my dog while under Sarah Hough and Pick Up The Paws care and under my own care as a result of following any instructions given me by Sarah Hough and Pick up the paws. I have been told by Sarah Hough and Pick Up The Paws and understand the inherent risks of owning a dog, including but not limited to the risk of dog bites to myself or others. Additionally, Sarah Hough and Pick Up The Paws will act with all due respect and caution in my home, in my absence and I hereby agree to indemnify and hold harmless Sarah Hough and Pick Up The Paws of any and all claims of damages to my home.All rights reserved Pick Up The Paws © 2023
